According to a memo obtained by The Times, the US Department of Health and Human Services is leading the effort to establish a legal definition of sex under federal civil rights law that bans gender discrimination in government-funded education programs. The new definition would not include gender identity or sexuality, effectively denying transgender people civil rights protections. A question-and-answer document from the same office, issued in 2014, stated that sex-based discrimination under Title IX extended to discrimination based on "gender identity or failure to conform to stereotypical notions of masculinity or femininity".

Oakley also asserted HHS continues to apply the law fairly and enforces all laws under its purview against discrimination.

For starters, the response appears to conflate two separate rulings in 2016 from U.S. District Judge Reed O'Connor in Texas, although both rulings were against transgender rights.

Transgender Law Center executive director Kris Hayashi added: "Because of fearless people like Ash Whitaker and Gavin Grimm and so many others, transgender and gender nonconforming communities have achieved wins in the courts. They have neither law nor fact on their side, and we will not accept this shameless attempt on the part of our government to erase the very existence of transgender members of our community". The judge issued a preliminary injunction previous year.

Levi said she's not certain, however, how seriously the Trump administration is pursuing the latest attack on transgender rights.

The Trump administration is considering a possible rollback of Obama-era recognitions and protections that broadened the definition of gender, according to a report Sunday.

The Education Department intends to publish the changes within weeks. "These reforms and more to come will put an end to the coerced, abusive LGBT Agenda originally enforced by the Obama Administration and his cabinet secretaries". Defining sex as "unchangeable" could also imply that a person's gender expression should match their sex that was assigned upon birth.

Gupta worked in the Justice Department's civil rights division during the Obama administration, and in her statement, said civil rights groups would use "every tool" they could to counter the reported Trump administration move. "As expressly stated in the Notice of Voluntary Dismissal filed by the plaintiff states this dismissal "necessarily dissolved" the preliminary injunction, which is no longer in effect".

"This is not a red or blue issue, this is a human issue", he said, to cheers and applause.

California has its own laws affording these students equal protection in schools, and other policies that cover transgender adults in workplaces, housing and health care. The reported HHS memo would affect many more areas of public life, the Times noted, from schools to prisons.

Advocates say the policy unfairly erases transgender people and turns back the clock on progress made for LGBTQ people under former President Barack Obama.
